Rental Purchase Agreement
Terms & Conditions

1. Payment, Price and Late Fees: Monthly payments will be made until the Final Price + tax on this contract is paid in full. Regardless of when the instrument is paid off, this is both the sales price and the total amount of all payments aside from late and/or repossession fees, because we assess no hidden fees nor interest. Monthly amount listed is due no later than the 10th of each month until the instrument is paid off or returned. Payments over 5 days late will incur a late fee (reinstatement fee) of $2 each month or 5% of the delinquent payment, whichever is more, and Mountain Music may charge amount owed to card on file. Repossession fees will be $20 per instrument, plus late fees. A $30 service charge will be added for returned checks. Rental Customer may purchase the instrument early by paying remaining balance at any time.

2. Ownership: Mountain Music will retain ownership of the instrument until the total sales price plus tax is paid in full. Payments and final sales prices do not include payment for other items listed on this contract or any other purchase or services provided by Mountain Music of Wyoming, LLC. Total number of payments to be paid in full are:______.

3. Default and Reinstatement: Customer will be in default if any of the following happens: (a) customer fails to make required payments by the due date. (b) customer becomes involved in bankruptcy. (c) property is transferred sold/given/lent out from the above property. Within 30 days of returning or voluntarily surrendering the instrument, the rental customer may reinstate for an instrument of similar value by paying all past due fees that apply.

4. Remedies: Mountain Music of Wyoming, LLC may pursue any legal remedy including but not limited to collections, repossession and legal action, regardless of previous restraint. Customer will be responsible for collection, court and attorney fees if turned to collections.

5. Return and Cancellation: A Rental Customer may cancel at any time by returning the instrument in the same condition as rented without penalty to Mountain Music of Wyoming, LLC. The rental customer will owe any outstanding months rent and any charges for damage but will terminate liability for any future payments as well as claims to equity unless reinstated within the parameters given in this contract.

6. Receipt: The Rental Customer is entitled to receive a copy of this contract.

7. Liability Damage Waiver, Damage, and Use: The Rental Customer is responsible for care and protection of the instrument. (If Liability Damage Waiver is selected, see Liability Damage Waiver.) Mountain Music of Wyoming, LLC will retain responsibility for warranty repairs until payment is made in full. Customer is responsible for repair of any damage to the instrument up to the fair market value of the instrument as well as consumable accessory components such as strings and reeds. No outside insurance policy is necessary but is encouraged, including homeowners and renters insurance. Mountain Music of Wyoming, LLC will ultimately decide on necessity of repair or replacement (loss) while under contract and will bill customer accordingly. Repairs from outside sources may void the instrument warranty if worked on by an unauthorized repair person independent of our policy.

A Rental Customer may cancel at any time by returning the instrument in the same condition as rented without penalty to Mountain Music of Wyoming, LLC. Instrument must be returned prior to the 1st of the month to avoid being charged for the full month. The rental customer will owe any outstanding months rent and any charges for damage but will terminate liability for any future payments.  Failure to return instrument without making payment may result in collection charges up to the full purchase price plus collection fees. Customer will be responsible for collection costs, court and attorney fees if default occurs.

4. Liability Damage Waiver, Damage, and Use: Same terms as the Rent to Own. If not enrolling in protection plan, instrument must be returned without damage to avoid additional charges.
